2. Account Registration

To make purchases on our platform, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account or any other breach of security. American Gold Trading will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3. Product Purchases

All precious metals products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our sole discretion. Product prices are subject to change without notice and reflect current market conditions.

Precious metals prices fluctuate constantly. The price you see at checkout is locked in for a limited time (as indicated during the checkout process). If you do not complete your purchase within the specified timeframe, pricing may change and inventory may no longer be available.

All sales are final once payment has been processed and confirmed. Please review your order carefully before completing your purchase.

4. Payment Terms

We accept payments via ACH bank transfer and cryptocurrency. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.

ACH Payments: ACH payments typically take 3-5 business days to clear. Your order will be processed once payment has been successfully received and cleared. If your ACH payment fails, your order may be cancelled.

Cryptocurrency Payments: Cryptocurrency payment terms and processing times vary by payment method. All cryptocurrency transactions are final and non-refundable once confirmed on the blockchain.

5. Shipping & Delivery

Shipping times vary based on product availability, payment clearing, and destination. Estimated delivery times are provided for reference only and are not guaranteed. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

All shipments are fully insured for the purchase price. Once a shipment has been delivered and signed for, risk of loss transfers to you. If you believe your shipment was not delivered or was delivered damaged, you must notify us within 48 hours of the delivery date.

6. Returns & Refunds

Due to the nature of precious metals trading and market volatility, all sales are final. We do not accept returns or issue refunds except in cases where:

• The product received is materially different from what was ordered
• The product arrives damaged (subject to our inspection and verification)
• We are unable to fulfill your order due to inventory or supply issues

Any approved returns must be shipped back in the original packaging with full insurance. You are responsible for return shipping costs unless the return is due to our error.

7. Privacy & Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to our collection and use of your information as described in the Privacy Policy.

To the fullest extent permitted by law, American Gold Trading shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on our services
• Unauthorized access, use, or alteration of your transmissions or content
• Market volatility or price fluctuations in precious metals

Our total liability for any claims arising from or related to these Terms of Service or our services shall not exceed the amount you paid us in the six months preceding the claim.

9. Governing Law & Dispute Resolution

These Terms of Service and any dispute arising from or related to your use of our services shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the changes taking effect.
